Welcome to WayBalance. These Terms of Service (“Terms”) govern your use of the WayBalance application (“App”) and the WayBalance website at waybalance.app (“Website”). By using the App or Website, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using WayBalance, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of Service

WayBalance is a health and wellness tracking application that provides:

• Weight logging with trend analysis and 7-day moving average
• BMI calculation with WHO regional context
• Water intake tracking with daily goals and streaks
• Step counting via Apple HealthKit integration
• Goal prediction and milestone celebrations
• Home screen widgets for weight, BMI, water, and steps
• Apple Watch companion app

All calculations and data processing are performed on your device. No internet connection is required for core functionality.

3. Health Disclaimer

WayBalance is not a medical device and does not provide medical advice.

• BMI calculations are estimates based on the standard formula and WHO guidelines — they do not account for individual factors such as muscle mass, bone density, or medical conditions
• Weight trend analysis is for informational purposes only and should not replace professional medical advice
• Water intake goals are general guidelines — individual hydration needs vary based on activity, climate, and health conditions
• Step counts are provided by Apple HealthKit and may vary in accuracy depending on your device and activity type
• Always consult a healthcare professional before making significant changes to your diet, exercise, or health routine

4. User Responsibilities

You agree to:

• Provide accurate data when logging health information
• Use the App responsibly and for personal health tracking only
• Not rely solely on WayBalance for medical decisions
• Comply with all applicable laws in your jurisdiction
• Respect the intellectual property rights of the developer

5. Licence Grant

We grant you a limited, non-exclusive, non-transferable, revocable licence to use WayBalance for personal, non-commercial purposes. You may not:

• Redistribute, sublicence, or resell the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App for commercial purposes without written permission
• Remove or alter any copyright or proprietary notices

6. Payment Terms

WayBalance offers a free tier and a Premium subscription with the following plans:

• Weekly— £1.99/week with a 7-day free trial
• Annual— £19.99/year with a 7-day free trial
• Lifetime— £34.99 one-time purchase

Important details about subscriptions:

• Subscriptions are processed and managed entirely through the Apple App Store
• Free trials automatically convert to paid subscriptions unless cancelled at least 24 hours before the trial ends
• Subscriptions auto-renew unless cancelled in your Apple ID subscription settings
• Refund requests must be directed to Apple, as they handle all payment processing
• Prices may vary by region and are subject to change with notice
• We do not collect or store any payment information

7. Intellectual Property

WayBalance, including its design, code, algorithms, branding, and content, is owned by Kukkdi Ltd. All rights reserved.

You retain full ownership of all data you enter into the App. Your health data belongs to you.

8. Limitation of Liability

WayBalance is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.

To the maximum extent permitted by law, Kukkdi Ltd shall not be liable for:

• Any direct, indirect, incidental, or consequential damages
• Health decisions made based on information provided by the App
• Inaccuracies in BMI calculations, weight trends, or step counts
• Loss of data, whether stored locally or synced via iCloud
• Interruption or unavailability of the App or any features

Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim.

9. Third-Party Services

WayBalance integrates with the following third-party services, each governed by their own terms:

• Apple CloudKit — for optional iCloud sync
• Apple HealthKit — for step reading and weight writing
• Apple App Store — for distribution and payments
• TelemetryDeck — for anonymised analytics and crash reporting

10. Changes to Terms

We may update these Terms from time to time. Changes will be reflected by an updated date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. For significant changes, we will provide notice through the app or App Store release notes.

11. Termination

You may terminate these Terms at any time by deleting the App from your device. We reserve the right to discontinue the App or revoke your licence if you violate these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
